What is a notarization?

A Notarization provides verification of a document signer's willingness to sign and that the signer is the person identified by the signature. Notarization does not prove the truthfulness of the contents of a document, does not validate a document nor render it legal.

What is a Notary Public?

Texas Notaries Public are commissioned by the Secretary of State as a public officer qualified and bonded under the laws for the performance of notarial acts with the same authority as the county clerk to take acknowledgments or proofs of written instruments; protest instruments permitted by law to be protested; administer oaths; take depositions; and certify copies of documents not recordable in the public records. Sometimes a Notary Public is just called Notary. Also in addition to being bonded, many are insured by private companies. Texas 911 is also insured in addition to being bonded. What must I know before meeting with a Notary?

Please do not sign the document prior to my arrival. Personal appearance by the signor is always required. The document date and the notarization date do not have to be the same. The notarization date is the actual date the signor appears before the notary.

Does my document need to be embossed with a Notary Seal?

Embossed Seals are recommended for all documents destined for overseas and international recipients. Also, embossed seals make an elegant finish to ceremonial documents. Gold foil for seals are provided for embossing as a courtesy, if you desire.

Retrieving Vehicles Impounded at a Vehicle Storage Facility

To get a vehicle out of a Texas vehicle storage facility often requires a Vehicle Storage Facility (VSF) Release Form VSF011 which needs to be notarized. However, insurance agents do not need any notarizing. This TDLR revised version replaces all previous versions of the form and "all Vehicle Storage Facilities must immediately begin using this version of form VSF011 when releasing a stored vehicle, when allowing access to the vehicle by an insurance adjuster, or when allowing access by a representative of the owner." according to the TDLR website. Note that this form replaces the Affidavit of Right of Possession (Form VSF009), Notice of Right of Possession for Salvage or Repair (Form VSF 006), Specific Power of Attorney (VSF 007), the Proof of Loss Claim Form (VSF 008) and Appointment of Authorized Representative for Inspection of Motor Vehicle (VSF 005).

The vehicle storage facility must release the vehicle to a person who provides the following and which you must take to them: Payment of all fees due, PLUS a valid photo identification issued by the state or federal government (usually a drivers license) where the name, address on the identification and the proof of authority (one of the eight items below) must match PLUS ANY ONE of the following eight items (to show proof of authority):

  • A notarized power of attorney (Form VSF011) OR

  • A court order OR

  • A certificate of title OR

  • A tax collector’s receipt and vehicle registration renewal card OR

  • A notarized proof of loss claim of theft from an insurance company to show a right of possession OR

  • Positive name and address information that corresponds to the information contained in TXDOT Vehicle Titles and Registration files OR

  • A valid Insurance Certificate for the vehicle OR

  • A TDLR-approved notarized (except for insurance agents) Affidavit of Right of Possession and Control (Form VSF011)

  • For taking the deposition of a witness, 50 cents for each 100 words;
